We proudly represent clients across all 50 states, standing by the guiding principles of the Violence Against Women Act (VAWA).

VAWA was enacted in 1994 to protect immigrants from abusive relationships. Under VAWA, victims of abuse, regardless of their gender, can obtain their own permanent residence or green card independently of their abusive spouse or parent who is a U.S. citizen or lawful permanent resident.

VAWA extends its protections through three primary avenues:

  • VAWA Based on a Spousal Relationship: If you are, or were, married to a U.S. citizen or lawful permanent resident and have suffered abuse, you may qualify under VAWA.

  • VAWA Based on a Parental Relationship: If you are the child of a U.S. citizen or lawful permanent resident and have been subjected to abuse by that parent, VAWA may offer you protection.

  • VAWA for Parents: If you are a parent who has been abused by your U.S. citizen son or daughter, you may also be eligible for relief under VAWA.

A significant advantage of VAWA is its provision for "self-petitioning," enabling victims to apply for legal status independently, even those who entered the U.S. illegally. This allows eligible individuals to apply for a green card without needing sponsorship from the abusive relative, or having them involved or even aware of the process.

Navigating VAWA can be complex, but you don't have to face it alone. WHK Law Firm provides compassionate, confidential, and comprehensive legal support to victims across the nation.
